Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you and Lumon LLC (“Lumon LLC,” “we,” “us,” or “our”), the company that operates ChompIt (the “Service”), including the ChompIt mobile app, the chompit.app website, and related features.

By creating an account, joining the waitlist, or otherwise accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

ChompIt is a cash-back service. You spend your own money as usual at participating local businesses, then scan your receipt in the app. Once a receipt is verified, you earn cash back, which accrues in the app and is paid out to your linked bank account through our third-party payments processor when you choose to cash out. There are no points, and no coupon to show at the register — you pay the business the ordinary amount and ChompIt pays you back. Certain participating businesses may instead fund a gift card as the reward, which the app will make clear before you visit.

• Cash back is a reward you earn for verified purchases at participating businesses, funded by ChompIt and/or its partners.
• Referral and creator rewards are amounts payable for verified activity you drive (such as inviting a new user who completes qualifying visits), on the terms described in-product.
• ChompIt does not issue a payment card and does not process the payment between you and the business. You pay the business directly; we verify your purchase from the receipt you scan (see Section 5) and pay your cash back to your bank through our payments processor.

You must be at least 18 years old and a resident of the United States to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide is accurate and complete. Certain features (such as creator payouts) may require additional verification.

You are responsible for the activity that occurs under your account and for keeping your login credentials secure. Notify us promptly at support@chompit.app if you suspect unauthorized use of your account. We may suspend or close accounts that violate these Terms or that we reasonably believe present a risk of fraud or harm.

ChompIt does not issue a payment card and does not process the payment between you and the business. You buy from the business normally, at full price, using whatever payment method you choose. To earn cash back, you then scan or photograph your receipt in the app. Verified cash back accrues to your in-app balance and is paid to your linked bank account through our third-party payments processor when you request a cash-out and meet the minimum shown in the app.

• Receipt verification. By scanning a receipt, you confirm it reflects a genuine purchase you made and authorize us to use the receipt image and its details to verify the purchase, prevent fraud, and calculate your cash back.
• Cash-out and payouts. To receive cash back, you connect a payout account through our third-party payments processor, which collects the information it needs (which may include identity and bank-account details) to pay you. We do not store your full bank credentials ourselves. Payouts may be delayed, held, or reversed where a purchase cannot be verified or fraud is suspected.
• Rates and availability. Cash-back rates, bonuses, daily and other limits, minimum cash-out amounts, and which businesses participate are described in-product, may vary by user and over time, and may be changed or withdrawn by us.
• A purchase earns cash back only when a scanned receipt is successfully verified. We may decline to pay cash back where a receipt is missing, illegible, duplicated, altered, backdated, or appears fraudulent, or where the purchase does not qualify.
• Accrued cash back has no value except as cash paid out under these Terms, cannot be transferred, and may expire or be limited per user as described in-product.

You agree not to:

• use the Service for any unlawful, fraudulent, or deceptive purpose, including staging fake visits or submitting altered or fabricated receipts to obtain discounts or commissions;
• interfere with, disrupt, reverse-engineer, or attempt to gain unauthorized access to the Service or its systems;
• misrepresent your identity, impersonate others, or provide false verification information; or
• use the Service in a way that violates the rights of businesses, creators, other users, or any third party; or
• post, stream, or share objectionable content — including harassment, bullying, threats, hate speech, sexually explicit or violent material, content that exploits or endangers minors, or content promoting illegal activity or self-harm.

We have zero tolerance for objectionable content and abusive behavior. Anything you post — including live streams, live chat messages, reels, photos, and profile details — is user-generated content that you are responsible for.

Every live stream, reel, and creator profile can be reported from within the app, and you can block any user so their content and messages no longer reach you. Reports are reviewed and content that violates these terms is removed, typically within 24 hours of review. Accounts responsible for it may be suspended or permanently removed. Hosts can also remove comments, mute, and remove viewers from their own live streams.

We may investigate suspected abuse and may withhold or reverse rewards, commissions, or payouts associated with it.

If you participate as a creator, you may earn a commission on visits that are verified by receipt as attributable to a Chomp you shared. You agree to:

• share only accurate, non-misleading content and to disclose your relationship with ChompIt where required by law (including applicable advertising and endorsement rules);
• provide accurate payout and, where required, tax information; and
• not engage in self-dealing, fake visits, or other activity designed to inflate commissions.

Commission rates, eligibility, and payout timing are described in-product and may change. Payouts are made only on verified visits and may be delayed, withheld, or reversed in cases of suspected fraud, chargebacks, or breach of these Terms.

If you participate as a business, you authorize us to verify customer purchases at your locations from scanned receipts and to run cash-back, referral, and related reward programs and reporting associated with your business. Where a program is funded in whole or in part by you (for example, a partner-funded gift card or boosted rate), pricing, fees, and settlement terms are set out in your separate merchant agreement, which controls in the event of a conflict with these Terms.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that Chomps or business deals will always be available.

To the maximum extent permitted by law, Lumon LLC and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amounts you paid us in the twelve months before the claim or (b) US $100.

You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, if required by a partner or by law, or to protect the Service or its users. Upon termination, your right to use the Service ends, though certain provisions (including Sections 9 through 13) survive.

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means and update the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State in which Lumon LLC is organized (the State of Delaware), without regard to its conflict-of-laws rules. The exclusive venue for disputes not subject to arbitration will be the state and federal courts located in that State, to the extent permitted by applicable law.
