Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you and Lumon LLC (“Lumon LLC,” “we,” “us,” or “our”), the company that operates MunchCard (the “Service”), including the MunchCard mobile app, the munchcard.app website, and related features.

By creating an account, joining the waitlist, or otherwise accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

MunchCard is a creator-powered local-deals service. Customers discover participating businesses through creator reels and claim a promotional deal (a “Munch”). At the business, the customer shows the claimed Munch at checkout and receives the discount directly off their bill — there is no card to link, no points, and no gift card. After the visit, the customer scans their receipt in the app, which verifies the visit. Creators who share a Munch may earn a commission on verified visits.

• Munches are promotional deals made available by participating businesses and redeemed in person at checkout.
• Creator commissions are amounts payable to creators for visits attributable to a Munch they shared, once those visits are verified by a scanned receipt.
• MunchCard does not issue a payment card, does not process your payment, and does not hold your funds. You pay the business directly, and visits are verified by the receipt you scan (see Section 5).

You must be at least 18 years old and a resident of the United States to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide is accurate and complete. Certain features (such as creator payouts) may require additional verification.

You are responsible for the activity that occurs under your account and for keeping your login credentials secure. Notify us promptly at support@munchcard.app if you suspect unauthorized use of your account. We may suspend or close accounts that violate these Terms or that we reasonably believe present a risk of fraud or harm.

MunchCard does not issue a payment card and does not process your payment. To use a Munch, you save it in the app and then show it at checkout at the participating business, which applies the discount directly to your bill. You pay the discounted total to the business in the ordinary way, using whatever payment method you choose. To confirm the visit and enable creator payouts, you then scan or photograph your receipt in the app.

• Redemption is in person. A Munch is redeemed at checkout at the time of your visit. We do not see, store, or process your card or bank details, and we are not a party to the payment between you and the business.
• Receipt verification. By scanning a receipt, you confirm it reflects a genuine visit and authorize us to use the receipt image and its details to verify the visit, prevent fraud, and calculate creator commissions.
• Quantity and availability. Businesses set the discount, a default deal, and how many Munches are available. A Munch you claim may sell out, expire, or be modified or withdrawn by the participating business or by us.
• A visit is treated as “verified” when a scanned receipt is successfully matched to a claimed Munch. We may decline to honor a discount or verify a visit where a receipt is missing, illegible, duplicated, or appears fraudulent.
• Munches have no cash value except as required by law, cannot be exchanged for cash, and may expire or be limited per customer.

You agree not to:

• use the Service for any unlawful, fraudulent, or deceptive purpose, including staging fake visits or submitting altered or fabricated receipts to obtain discounts or commissions;
• interfere with, disrupt, reverse-engineer, or attempt to gain unauthorized access to the Service or its systems;
• misrepresent your identity, impersonate others, or provide false verification information; or
• use the Service in a way that violates the rights of businesses, creators, other users, or any third party.

We may investigate suspected abuse and may withhold or reverse rewards, commissions, or payouts associated with it.

If you participate as a creator, you may earn a commission on visits that are verified by receipt as attributable to a Munch you shared. You agree to:

• share only accurate, non-misleading content and to disclose your relationship with MunchCard where required by law (including applicable advertising and endorsement rules);
• provide accurate payout and, where required, tax information; and
• not engage in self-dealing, fake visits, or other activity designed to inflate commissions.

Commission rates, eligibility, and payout timing are described in-product and may change. Payouts are made only on verified visits and may be delayed, withheld, or reversed in cases of suspected fraud, chargebacks, or breach of these Terms.

If you participate as a business, you set the discount, your default deal, and the quantity of Munches you make available, and you are responsible for honoring saved Munches at checkout in accordance with their terms. You authorize us to facilitate creator commissions and related reporting for your Munches. Pricing, fees, and settlement terms are set out in your separate merchant agreement, which controls in the event of a conflict with these Terms.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that Munches or business deals will always be available.

To the maximum extent permitted by law, Lumon LLC and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amounts you paid us in the twelve months before the claim or (b) US $100.

You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, if required by a partner or by law, or to protect the Service or its users. Upon termination, your right to use the Service ends, though certain provisions (including Sections 9 through 13) survive.

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means and update the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State in which Lumon LLC is organized (the State of Delaware), without regard to its conflict-of-laws rules. The exclusive venue for disputes not subject to arbitration will be the state and federal courts located in that State, to the extent permitted by applicable law.
